1. Acceptance of Terms

By accessing and using the Clean E website and services ("Services"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Services.

2. Registration

To access certain features of the site and services, you may need to register and create an account. You agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete.

3. Privacy

Your use of the Services is also governed by our Privacy Policy, which can be found in the following section, titled "Privacy".

4. Charging Services

Users can initiate and stop charging sessions for their electric vehicles using the Services. The cost of charging sessions will be calculated based on the duration of the session and the applicable rates. Users are required to have a valid payment method on file to use the charging services.

5. Text Notifications

Users have the option to receive text notifications about their charging sessions. Users must agree to receive text notifications and provide a valid phone number to use this feature. Standard messaging rates may apply based on the user's mobile carrier.

6. Vehicle Information

Users have the option to provide vehicle information, including but not limited to the vehicle model, make, year, and license plate number. This information is used to enhance the Services and provide a personalized user experience.

7. Payment and Pricing Model

Users will be charged for the Services through the payment method on file. By using the Clean E charging Service, users agree to pay the specified charges and fees. Clean E implements a time-based pricing model for electric vehicle charging:

Standard Charging Fee: $2.50 per hour for the duration of the charging session.
Overtime Fee: After 10 hours of charging, a reduced overtime fee of $0.50 per hour will be applied.

A preauthorization amount of $1.00 is applied to the payment method on file
at the time of the transaction.

Clean E uses Stripe for secure online payment processing. To learn more about Stripe, visit www.stripe.com.

8. Limitation of Liability

Clean E shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the services.

9. Termination

Clean E reserves the right to terminate or suspend your account and access to the Services, for any reason, including without limitation, if we believe that you have violated these Terms.

10. Changes to Terms

Clean E may modify these Terms at any time. If we make changes to these Terms, we will notify users through the Services or by other means. Continued use of the Services after the changes have been made will constitute acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Clean E operates, without regard to its conflict of law provisions.

Privacy

Data Privacy Policy

At Clean E, your privacy is of paramount importance to us. We are committed to ensuring the safety and protection of your personal information.

Financial Data: We prioritize your financial security. We do not store or have access to your financial details. All financial transactions are processed securely through Stripe, a world leader in online payment processing.

This privacy policy applies to the Clean E Webapp (hereby referred to as "Application") for mobile devices that was created by Clean E (hereby referred to as "Service Provider") as a Free service. This service is intended for use "AS IS".

‍Information Collection and Use

The Application collects information when you create an account and use it. This information may include information such as

Your device's Internet Protocol address (e.g. IP address)
The pages of the Application that you visit, the time and date of your visit, the time spent on those pages
The time spent on the Application
The operating system you use on your mobile device

The Application does not gather precise information about the location of your mobile device.

The Service Provider may use the information you provided to contact you from time to time to provide you with important information, required notices and marketing promotions.

For a better experience, while using the Application, the Service Provider may require you to provide us with certain personally identifiable information, including but not limited to Email, Name, Billing Address, and other Billing details handled through Stripe. The information that the Service Provider request will be retained by them and used as described in this privacy policy.

‍Third Party Access

Only aggregated, anonymized data is periodically transmitted to external services to aid the Service Provider in improving the Application and their service. The Service Provider may share your information with third parties in the ways that are described in this privacy statement.

The Service Provider may disclose User Provided and Automatically Collected Information:

as required by law, such as to comply with a subpoena, or similar legal process;

with their trusted services providers who work on their behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

‍Opt-Out Rights

You can stop all collection of information by the Application easily by deleting your account or not using the service. You can find these settings under your profile page once an account has been created.

‍Data Retention Policy

The Service Provider will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. If you'd like them to delete User Provided Data that you have provided via the Application, please contact them at admin@clean-e.com and they will respond in a reasonable time.

‍Children

The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13.

The Application does not address anyone under the age of 13. The Service Provider does not knowingly collect personally identifiable information from children under 13 years of age. In the case the Service Provider discover that a child under 13 has provided personal information, the Service Provider will immediately delete this from their servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact the Service Provider (admin@clean-e.com) so that they will be able to take the necessary actions.

The Service Provider is concerned about safeguarding the confidentiality of your information. The Service Provider provides physical, electronic, and procedural safeguards to protect information the Service Provider processes and maintains.

This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to the Privacy Policy by updating this page with the new Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
